Terms of Service

Please read these Terms of Service (“Terms”) carefully. By accessing or using Pulse, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Agreement and Eligibility

These Terms are a binding agreement between you (whether individually or on behalf of an entity, “you,” “Customer”) and Pulse, operated by Sarim Tahir, a sole proprietor based in Karachi, Pakistan (“Pulse,” “we,” “us”). You must be at least 18 years old and able to form a binding contract. If you accept on behalf of an organization, you represent that you have authority to bind it.

2. Changes to These Terms

We may modify these Terms at any time, at our sole discretion. For material changes, we will provide reasonable notice through the Service or by email before they take effect. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to a change, your remedy is to stop using the Service and cancel.

3. The Service

Pulse provides conversion tracking and attribution for organic content, including integrations with channels such as YouTube, a website tracking script, and connections to CRM and conversion tools. We grant you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Service during your subscription, subject to these Terms. We may update or modify the Service over time, provided changes do not materially reduce core functionality during a paid term.

4. Accounts

You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use. We are not liable for losses arising from unauthorized use of your account that results from your failure to safeguard your credentials.

5. Customer Data and End-User Data

Your data. You retain all rights to the data you provide or that Pulse collects on your behalf through your connected channels and tools (“Customer Data,” including data about your end users and CRM contacts). You grant us a non-exclusive, worldwide, royalty-free license to process Customer Data solely to provide, maintain, secure, and improve the Service, and as otherwise permitted by our Privacy Policy.

Your responsibilities. You are solely responsible for the legality of the data you collect through Pulse and for your use of the Service. You represent and warrant that you have all necessary rights, consents, and notices in place — including any required cookie or tracking consents and privacy disclosures to your website visitors, audience, and CRM contacts, and the right to share that data with us — to collect and process end-user data through the Service. You are responsible for notifying your visitors and contacts of any tracking as required by applicable law. You will comply with all applicable laws, including data protection and privacy laws (such as GDPR and CCPA where applicable).

Aggregated data. We may create and use de-identified, aggregated data derived from use of the Service for benchmarking, analytics, and improving the Service. This data does not identify you or any individual.

6. Third-Party Integrations

The Service integrates with third-party platforms (e.g., Google/YouTube, Calendly, Fillout, CRMs, and payment platforms such as Stripe and Whop). Your use of those platforms is governed by their own terms and privacy policies, and your Pulse integrations are subject to their requirements, including Google’s API policies and any restrictions your CRM places on connected applications. We are not responsible for third-party services, and they may change or discontinue access in ways that affect the Service.

7. Fees, Billing, and Subscriptions

Pulse is offered on a subscription basis with monthly and annual billing options at the prices listed at pulsetracker.app/pricing. Payments are processed by our payment provider, Paddle, which acts as the merchant of record for transactions. This means Paddle handles billing and may appear on your card or bank statement in connection with your purchase. By subscribing, you authorize Pulse and Paddle to charge your payment method on a recurring basis — monthly or annually, depending on the plan you select — until you cancel.

Subscriptions renew automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date. You are responsible for all applicable taxes, except those collected and remitted on your behalf by Paddle as merchant of record. We may change pricing for future billing periods with reasonable notice.

8. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription remains active until the end of the current billing period, after which it will not renew, and you will retain access until that period ends.

New customers are covered by a 14-day money-back guarantee on their first payment, as described in our Refund Policy. Outside that window, all fees are non-refundable except where required by applicable law. Cancelling stops future charges; it does not refund the current period. 9. Acceptable Use

You agree not to: use the Service for any unlawful or fraudulent purpose; generate fake, simulated, or fraudulent tracking activity; violate the rights of any third party; attempt to gain unauthorized access to the Service or its systems; reverse engineer, decompile, or disassemble the Service; scrape or extract data through unauthorized automated means; resell or sublicense the Service without authorization; introduce malware or interfere with the Service’s operation; or use the Service to process sensitive categories of data it is not designed for (such as protected health information). We may suspend or terminate access for violations.

10. Intellectual Property

Pulse and its licensors own all rights in the Service, including all software, design, and trademarks. Except for the limited rights granted to you here, no rights are transferred. Any feedback or suggestions you provide may be used by us without restriction or obligation to you.

11. Termination

Either party may terminate these Terms if the other materially breaches and fails to cure within 30 days of written notice. We may suspend or terminate your access immediately if you breach these Terms, fail to pay, or present a security risk. Upon termination, your right to use the Service ends. We may retain your data for a limited period after termination to allow reactivation and as required for legal compliance, after which it will be deleted.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that attribution data will be complete or perfectly accurate, as tracking depends on third-party platforms, browser behavior, and factors outside our control.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold Pulse harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, your violation of these Terms, or your violation of any law or third-party right — including any claim that your collection of end-user data lacked proper consent or notice.

15. Governing Law and Disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules. The courts of Karachi, Pakistan will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to that jurisdiction. You agree that any claims will be brought on an individual basis and not as part of a class action. Nothing in this section affects payment disputes handled by Paddle as merchant of record under its own terms.

16. General

These Terms are the entire agreement between you and Pulse regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
